$16,000,000.00: Failure To Deliver Baby Before Placental Abruption Caused Brain Damage
This New York birth injury lawsuit was filed by a mother and father against a Syracuse hospital and its medical residents. The complaint alleged obstetrical malpractice, including a failure to appreciate that the mother's bicornuate uterus made her high risk for labor and delivery complications, for failing to deliver the baby at 38 weeks (as originally planned) before a placental abruption caused profound hypoxia. The baby was born birth depressed. She was transported to the NICU where she experienced seizures on day one of life. Brain imaging revealed profound brain damage. Subsequently, the child was diagnosed with hypoxic ischemic encephalopathy, spastic quadriplegic cerebral palsy, and a permanent seizure disorder. A New York State Court of Claims Judge found for the plaintiff on liability and awarded damages in excess of $16,000,000.00. Bottar Law, PLLC, was co-counsel.
